ordinance, frustrating developers who find that a few large puddles

1-99: On opening real estate tax bills, it is discovered that THE VALUATIONS OF BENNETT AND SMITH PARCELS (site of the proposed Avon Commons) WERE ENORMOUSLY INCREASED in 1998. Some 1998 Smith tax valuations are more than 1000% greater than the 1997 real estate valuations.
Valuation data supplied by the Lorain County Treasurer indicate that NO PARCEL OPTIONED BY A JACOBS ENTITY for the "Vista" project (1,000,000 square feet of retail floor space) HAD A VALUATION INCREASE FROM 1997 TO 1998.
No land east of State Route 83 in Avon was zoned for shopping centers after Judge Thomas Janas' decision against Avon on June 8, 1998. First Interstate and the Jacobs Group both faced referendum elections on the land they each had optioned. Why was land under option to Jacobs in 1998 favored with no increase in real estate tax valuation?
Smith parcel -015-103-002 second half 1997 tax was $639.19 (due in July 1998).
Smith parcel -015-103-002 first half 1998 tax was $10,852.77 (due in January, 1999).

OHIO SUPREME COURT DECISION: JUNE 1, 1999, SPECIAL ELECTION, AVON, OHIO
On May 3, the board's counsel sent a facsimile copy of a preliminary
protest investigation report in which the board's director tentatively
concluded that most of relators' specified challenges were meritless.
On May 7, after the board's previously imposed deadline had expired, relators notified the board that a handwriting expert would testify at the May 10 protest hearing.
On May 10, the board conducted an initial protest hearing before two of
its four members. One of the board members [Tom Smith] had recused
himself due to a conflict of interest and another member was not
present. The board proceeded with the hearing, and relators refused to
have their expert testify because of the presence of only two
board members.
